What commercial names that I might recognize have been created by NameFactory?

    Key staff members and associates are selected by NameFactory based on a track-record of creating names and expressions that have proven their value in commercial enterprises.  Every aspect of the work for each NameFactory client is performed under the terms of a strict non-disclosure agreement.  Clients are assured full control over NameFactory's work on their behalf along with all public disclosures of their own methods for deriving and branding names.  As a matter of policy, NameFactory does not identify clients and therefore it is not appropriate to disclose commercial names to third parties as references for future assignments.
How much does NameFactory need to know about my company's products and operations?
    Obviously the more we know about the assignment -- including the policies and 'culture' of your company, the specifications and applications for your products and services, the target markets and competitive environment -- the more likely we will be able to satisfy your requirements.  Most backgound information that NameFactory needs to know will be found in public documents, such as annual reports, product literature, and data sheets. All proprietary information provided by your company will be held in strictest confidence under the non-disclosure provisions of the NameFactory's Agreement for Services.
How does NameFactory conduct its investigation into my company and products?
    Primarily by E-Mail and by facsimile. You are responsible for authorizing points of contact within your company.  Unlike more expensive naming consultants, NameFactory does not routinely meet with your people or conduct data-gathering surveys on-site. The NameFactory Agreement for Services covers all fees for in-person services and studies that you determine to be required, including participation in 'brain-storming' sessions, all on a time-and-materials basis.
What if a name provided by NameFactory was already thought of by my company?
    Go ahead and use it. NameFactory will never charge you for anything you have created before we send you our recommendations. Simply document your prior claim in a letter on company letterhead signed by an officer of your company within the 10-day consignment interval.
How can I document that my company independently had the idea?
    There are many conventional ways for diarizing creative work, including the use of dated pages in bound notebooks and internal memoranda. NameFactory recommends routinely sending copies by E-Mail to designated third parties as a means of establishing prior claims to names.
      NOTE: To save time, we recommend that you send a list of your rejected naming ideas to NameFactory along with the executed Agreement for Services. All information provided by your company will be held in strictest confidence under the non-disclosure provisions of the Agreement for Services.
What if a name provided by NameFactory is being used by another company?
    NameFactory will not charge you for any name you cannot use. The use of a brand name by others is a public act not a secret.  As stated in NameFactory's Agreement for Services, we consult publicly available information to ascertain whether our recommendations are available for your use.  However, NameFactory makes no such warranty.  For NameFactory's no-charge consignment services, we perform due-diligence searches primarily of web-based sources for readily available information about trademarks for products and company names.
      NOTE: The mere fact that a brand name is 'owned' by another company does not necessarily mean you will not be able to obtain a license to use it. Remember: 'Eagle' can be trademarked for an automobile and for a brand of beer. Check with your own legal counsel on these matters.
What if my company has paid NameFactory for a name that it cannot use?
    Your company is responsible for determining whether its use of a brand name is precluded. NameFactory gives your company one year within which to do so. NameFactory maintains a reserve account to refund fees received from your company for any name that is subsequently found to be precluded from use. Simply document your determination by letter on company letterhead signed by an officer of your company within one year of name selection.
How does my company make a selection from a NameFactory consignment?
    By E-Mail within 10 working days.
What does it mean to 'use' a NameFactory-consigned name?
    The NameFactory Agreement for Services defines 'use' based on each category of service, including conventional meanings that apply to product or company names and less obvious meanings for custom expressions created by NameFactory -- those you will want to 'use' for labeling unique concepts.  The mere appearance in documents published by your company generally constitutes a clear criterion for 'use'.
What does NameFactory charge for its services?
    You will find NameFactory's fees to be lower than traditional consulting services, which are customarily paid in advance. A fixed-price quotation will vary with the complexity of the assignment specified by your company, ranging from under $3,000 for a simple product name to over $30,000 for what NameFactory judges in advance to be an exceptionally powerful enterprise enabler.  Whatever the amount, you are under no obligation to pay for services not used. That's what makes NameFactory unique.
What if my company needs longer than 10 business days to decide?
    NameFactory recognizes that the act of creating a brand name marks the beginning not the end of a sequence of complex business activities. In making a selection from NameFactory's consignment list, your company may need extra time for focus groups or for the application of market research instruments. If so, appropriate adjustments can be negotiated in the consignment section of NameFactory's Agreement for Services.
How can my company justify paying for NameFactory's services?
    The business value of a brand name has been the subject of any number of books on business theory and history. The cost of creating a successful name can be huge. A half-dozen creative staffers in just one brain-storming session can cost your company thousands of dollars -- whether anything useful comes out of it or not. Moreover, prepaid retainers and consulting fees, which are not charged by NameFactory, would customarily have no money-back guarantees.
What if my company later decides to use a rejected name?
    After the exclusive 10-day consignment, we consider selections to be retained in NameFactory's 'inventory' of creative ideas, all of which may be marketed to others -- include your company. NameFactory's price in any future transaction will be based on all business factors then prevailing.
How does my company pay for NameFactory's services?
    An invoice will be sent by United States Postal Service. All other aspects of NameFactory's services are conducted by E-Mail.
How does NameFactory assure that my company will pay for a selected name?
    Your company does not pay for NameFactory's services unless you actually use one or more of the ideas submitted by NameFactory under the Agreement for Services. To document our claims -- and yours -- under the Agreement for Services, NameFactory routinely sends electronically authenticated copies of all correspondence to accredited third parties for archiving.
